Terms of Service for WineTrail

Welcome to WineTrail ("we," "our," "us"). WineTrail is a wine tracking app that helps you catalogue your wines, record tasting notes, and discover new wines.

By downloading, installing, or using WineTrail, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the app.

1. Eligibility

You must be of legal drinking age in your country of residence to use WineTrail. In the Netherlands this is 18 years old. If you are under the legal drinking age, you may not use this app.

2. Your Account

- You are responsible for maintaining the confidentiality of your account and login details.
- You are responsible for all activities that occur under your account.
- Notify us immediately if you believe your account has been compromised.

3. What WineTrail Does

WineTrail allows you to:
- Track wines you have tasted, purchased, or are interested in
- Record tasting notes, ratings, and personal observations
- Upload photos of wine labels or bottles
- Search for wine information from external sources (Grapeminds)

WineTrail is a personal tracking tool. It does not sell wine, verify wine authenticity, or provide professional sommelier advice.

4. Acceptable Use

When using WineTrail, you agree not to:
- Use the app for any unlawful purpose
- Upload harmful, misleading, offensive, or inappropriate content
- Attempt to interfere with the app's operation, security, or infrastructure
- Use automated tools to scrape data or overload the service
- Impersonate another person or misrepresent your identity

We may suspend or terminate your account if you violate these rules.

5. Content You Provide

You may add wine entries, tasting notes, photos, and other content ("User Content") to WineTrail.
- You retain all rights to your User Content.
- By adding User Content, you grant us a non-exclusive, worldwide license to store, process, and display it solely to provide the app's functionality to you.
- This license ends when you delete your content or your account.
- You are responsible for ensuring your User Content does not infringe on others' rights.

6. Intellectual Property

- The WineTrail app, its design, code, and branding are owned by us and protected by applicable laws.
- Wine data retrieved from third-party sources (such as Grapeminds) remains the property of the respective data providers and is subject to their terms of use.

7. Privacy

Your privacy is important to us. Our Privacy Policy explains how we handle your information. By using WineTrail, you agree to our Privacy Policy.

8. Service Availability

We do our best to keep WineTrail running reliably, but:
- We do not guarantee the app will always be available or error-free.
- We may update, modify, suspend, or discontinue features at any time.
- Planned maintenance will be communicated in advance when possible.

9. Disclaimer and Limitation of Liability

WineTrail is provided "as is" without warranties of any kind, either express or implied.

- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the app.
- We are not responsible for the accuracy of wine data retrieved from third-party sources.
- Our total liability to you for any claim related to the service is limited to the amount you have paid us in the preceding 12 months (or zero if the service is free).

10. Account Termination

- You may delete your account at any time. Upon deletion, your data will be permanently removed within 30 days.
- We may terminate or suspend your account for violation of these Terms, with notice where reasonably possible.

11. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you via the app or email before they take effect. Continued use of the app after changes become effective constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of The Netherlands. Any disputes arising from these Terms or your use of WineTrail will be resolved in the competent courts of The Netherlands.
